❌ We Do NOT Provide:

Structural Drawing review of third-party drawings
Any service not explicitly agreed in writing

3. Engagement Process

Contact via form or WhatsApp

Discussion & formal proposal

50% advance paid — work begins

Final 50% paid — delivery

WhatsApp/email confirmation is valid written agreement. No work begins without advance payment.

4. Payment Terms

Delayed payments may result in work being paused
Final deliverables withheld until full payment received

5. Project Timelines & Delays

BuildClarity provides reasonable estimated timelines and makes all efforts to deliver within agreed schedules.

Client-Side Delays Include:

Delayed submission of documents
Delayed responses to queries
Scope changes mid-project
Non-payment of installments

In such cases original timeline is null and void. Revised timeline communicated after resolution. Additional charges may apply. BuildClarity not liable for client-caused delays.

Force Majeure: Neither party liable for delays caused by natural disasters, pandemics, government actions, etc.

6. Intellectual Property

All deliverables remain BuildClarity's property until full payment received
Upon full payment, Client receives non-exclusive license for agreed project
Client may NOT resell or claim authorship of our work
BuildClarity may use anonymized data for portfolio unless confidentiality requested in writing

7. Client Responsibilities

Provide accurate and complete project information
Inform us immediately of scope changes
Make payments per agreed terms
Review deliverables within 7 working days
Ensure all shared documents are legally authorized by you

8. Limitation of Liability

Important: BuildClarity is a consultancy firm — not a contractor. We provide estimates, plans, and advisory.

Total liability shall not exceed total fee paid
Not liable for decisions made based on our advisory
Not liable for cost differences between estimate and actual construction
Not liable for third-party contractor or vendor failures
Not liable for loss of profit or business

9. Termination

By Client

Written notice required. Refund per our Refund Policy . 10% cancellation fee applies in all cases.

By BuildClarity

We may terminate immediately without refund if Client provides false information, behaves abusively, uses services unlawfully, or fails to pay.

10. Dispute Resolution

Good faith discussion within 30 days
If unresolved — arbitration under Arbitration & Conciliation Act, 1996
Jurisdiction: Courts in Mumbai, Maharashtra, India

11. Governing Law

Governed by Indian Contract Act 1872, IT Act 2000, DPDP Act 2023, and Consumer Protection Act 2019.

12. Amendments

BuildClarity may update these Terms at any time. Changes posted with revised date. Continued use constitutes acceptance.
